Door de coronamaatregelen werken veel grensarbeiders op dit moment noodgedwongen thuis. Deze homeoffice-dagen zijn normaal gesproken belast in het woonland en dit zou een verschuiving van de belastingplicht kunnen veroorzaken.<\/p>\n<p>Om dit te voorkomen, hebben Nederland en Duitsland nu afgesproken dat inkomen wordt belast in de staat waar normaal gesproken de werkzaamheden zouden zijn verricht. Er vindt kortom door homeoffice geen verschuiving van de belastingplicht plaats. Met deze afspraken sluiten Nederland en Duitsland aan bij de eerdere maatregel dat thuiswerken in verband met de coronamaatregelen geen gevolgen heeft voor de toepasselijke socialezekerheidswetgeving.<\/p>\n<p>Grensarbeiders moeten wel een passende administratie bijhouden van hun thuiswerkdagen en dit ook onderbouwen met een attest van de werkgever waaruit blijkt dat de thuiswerkdagen uitsluitend het gevolg waren van de coronamaatregelen. Let op: Voor grensarbeiders die dus altijd al een of enkele dagen homeoffice doen geldt bovenstaande niet. Deze dagen blijven in de regel belast in het woonland.<\/p>\n<h3>Belasting Kurzarbeitergeld en Arbeitslosengeld<\/h3>\n<p>Als gevolg van de coronacrisis zal een toenemend aantal grensarbeiders die in Nederland wonen een Duitse inkomensondersteuning krijgen in de vorm van een netto socialezekerheidsuitkering, zoals Kurzarbeitergeld, Insolvenzgeld of Arbeitlosengeld.<\/p>\n<p>Deze Duitse socialezekerheidsuitkering(en) zijn op het nettoloon afgestemd en zijn daarom in Duitsland vrijgesteld van belasting. Als deze uitkeringen (tezamen met bepaalde andere) Duitse (socialezekerheids)uitkeringen in een kalenderjaar \u20ac 15.000 of minder bedragen, wijst het belastingverdrag met Duitsland het heffingsrecht over deze Duitse netto-uitkeringen toe aan Nederland. Met als ongewenst gevolg dat Nederland dan zou heffen over een door Duitsland betaalde netto-uitkering van een grensarbeider die normaal in Duitsland had gewerkt en daar zou zijn belast voor zijn salaris.<\/p>\n<p>Vandaar dat Nederland nu heeft besloten om Kurzarbeitergeld, Insolvenzgeld en Arbeitslosengeld voor zover dat geacht wordt te zijn verkregen als gevolg van corona(maatregelen) vrij te stellen van belasting. Deze vrijstelling geldt voor de periode van 11 maart 2020 tot en met 31 december 2020.1<\/p>\n<h4>Meer informatie<\/h4>\n<p>De overeenkomst tussen Nederland en Duitsland loopt van 11 maart tot 30 april, maar wordt zonder opzegging van een van de betrokken staten automatisch verlengd.
